Unpaid Overtime Case Filed Against Metaltek

Our experienced unpaid overtime lawyers have filed a collective and class action lawsuit against MetalTek International, Inc. for failing to compensate its hourly employees for all overtime hours worked.

On August 17, 2022, our overtime attorneys at Coffman Legal filed a Collective and Class Action Complaint against MetalTek on behalf of its hourly employees because of MetalTek’s alleged failure to properly compensate its hourly employees for all overtime wages in violation of the federal Fair Labor Standards Act (FLSA), as well as under Ohio law.

Our lawsuit alleges that MetalTek does not pay for all overtime hours worked because it has a policy of only paying hourly employees for their scheduled shifts, and not paying these employees for any pre-shift work. We allege that hourly employees at MetalTek’s facilities frequently perform integral and indispensable pre-shift work such as meeting with and receiving instructions from supervisors, discussing issues with prior shifts, performing safety checks, gathering necessary equipment, and other preparatory job duties so production can be up and running at the scheduled start of their shifts. The law requires that MetalTek pay for time spent doing these pre-shift activities, even if they were performed before scheduled start times. MetalTek’s alleged failure to compensate hourly employees for pre-shift work resulted in unpaid overtime. Our lawsuit alleges that this conduct is a willful violation of federal and state wage and hour laws.

This unpaid overtime adds up significantly over weeks and years. The FLSA establishes the minimum overtime compensation that employees must be paid, and MetalTek’s non-exempt hourly employees are entitled to receive their full and proper compensation.

Our lawsuit seeks unpaid overtime wages for all hourly non-exempt employees since August 17, 2019, liquidated damages in an amount equal to the unpaid overtime (200% of the unpaid overtime damages total), attorneys’ fees and costs, among other things. The lawsuit was filed in the U.S. District Court for the Northern District of Ohio, Western Division (Toledo) and is entitled Herman v. MetalTek International, Inc., Case No. 3:22-cv-1476.
