What are the Allegations of the Meal Break Lawsuit?
This lawsuit states that The Christ Hospital requires that daily meal break deductions be taken from its hourly employees’ pay each day even if those employees are too busy taking care of patients or performing other tasks to take full, uninterrupted meal breaks.
If meal “breaks” are interrupted and/or shortened, employees may not actually have a “bona fide meal period” under the law. Employers cannot deduct a full meal break from employees’ hours worked if the break is essentially “split up” into multiple smaller breaks throughout the workday. In the healthcare field, employees are often unable to take fully uninterrupted meal breaks because they are too busy with work duties.
What are my Rights regarding Meal Breaks?
If you worked for The Christ Hospital and were unable to take fully uninterrupted daily meal breaks of at least 30 minutes where you were completely relieved of duty, The Christ Hospital may not have properly paid you. If you are able to eat, but you do so while eating on the go or you must otherwise eat very quickly without the ability to take 30 minutes of uninterrupted rest time, you are not likely receiving a bona fide meal period under the law. If you do not receive a bona fide meal break, then The Christ Hospital cannot deduct 30 minutes from your time worked because this time is otherwise work time for which you should be compensated.
What is the Overtime Lawsuit Seeking?
The lawsuit seeks unpaid wages from March 6, 2022 to the present. It was filed in the U.S. District Court for the Southern District of Ohio, Western Division at Cincinnati and is called Asbury v. The Christ Hospital, Inc., Case No. 1:25-cv-136
