What Are the Allegations in the Overtime Lawsuit Against The Campbell’s Company?
The lawsuit alleges that Campbell’s production/manufacturing employees arrive early before the start of their scheduled shift to take part in work activities like dressing in protective equipment or clothing, washing hands, receiving work assignments, and attending shift meetings. Although these production/manufacturing employees come in early to perform tasks before the scheduled start of their shifts, the lawsuit claims that Campbell’s does not pay employees for the work because pay begins at the start of the scheduled shift. The lawsuit claims that because Campbell’s allegedly failed to pay for pre-shift work, it has not fully compensated workers for all overtime wages earned.
What Could I Receive from the Lawsuit?
If we are able to establish in the lawsuit that Campbell’s workers were not properly paid for all overtime work performed for one or more reason(s), the Fair Labor Standards Act states that the workers could receive (1) unpaid overtime for up to the last three years of work and (2) liquidated damages in an amount equal to the unpaid overtime (aka the potential for double [2x or 200%] damages). The law also states that Campbell’s would be required to pay our firms’ attorneys’ fees and costs.
