UNPAID OVERTIME LAWSUIT FILED BY CALL CENTER EMPLOYEES AGAINST TELEPERFORMANCE USA (TPUSA) IS CONDITIONALLY CERTIFIED AS COLLECTIVE ACTION
Coffman Legal’s Overtime Attorneys filed a Collective and Class Action Lawsuit against Teleperformance USA (TPUSA) on behalf of call center employees in Ohio who were allegedly not compensated for all overtime work performed.
On May 20, 2019, Coffman Legal, LLC filed a Collective and Class Action Complaint against Teleperformance USA (TPUSA) on behalf of TPUSA’s Ohio call center employees for TPUSA’s alleged failure to fully compensate call center employees for all time that they spent working. In particular, the lawsuit alleges that TPUSA’s Ohio call center employees were not compensated for time they spent at TPUSA’s Ohio call centers searching for functioning computers, functioning headsets, and completing the computer bootup process. The case is filed as a collective action (under the Fair Labor Standards Act) and class action (under Ohio law).
The Complaint alleges that TPUSA’s failure to pay call center employees for all time working resulted in unpaid overtime in violation of the FLSA and Ohio law.
The lawsuit seeks unpaid overtime wages, liquidated damages in an amount equal to the unpaid overtime, attorney’s fees, and costs, among other things. The lawsuit was filed in the U.S. District Court for the Southern District of Ohio, Eastern Division (Columbus) and is titled Headspeth, et al v. TPUSA, Inc., Case No. 2:19-cv-2062. On July 8, 2020, the Court granted conditional certification of the proposed collective action and ordered that notice be mailed to all of TPUSA’s call center employees working in Ohio. Notice of the conditionally certified collective against against TPUSA for its failure to pay all overtime wages earned will be mailed in the coming days or weeks. In order to join the collective against, Ohio’s TPUSA employees will be required to return a consent form that indicates their consent to join the case.
