Our experienced and skilled unpaid overtime attorneys have recently filed a collective and class action lawsuit against Dungarvin, LLC alleging that it has failed to properly compensate its hourly in-home care employees, such as direct support professionals, caregivers, or home health aides, for all overtime hours worked.

On September 7, 2022, Coffman Legal filed a Collective and Class Action Complaint against Dungarvin on behalf of its hourly employees. Dungarvin has allegedly failed to properly compensate these in-home care employees in accordance with the federal Fair Labor Standards Act (FLSA) and under Ohio law.

The unpaid overtime lawsuit lawsuit alleges that Dungarvin does not properly compensate its hourly employees because it has a policy of not compensating employees for travel time between clients’ residences during the same workday. Hourly in-home care employees, such as direct support professionals, caregivers, or home health aides, would travel between homes while providing in-home care to multiple clients during the same day. Although they traveled between these clients’ residences as part of their work assignments, the overtime lawsuit alleges that Dungarvin did not compensate these employees for this time. As a result of this alleged failure to pay for travel time, many of Dungarvin’s hourly in-home care employees worked overtime but were not compensated for it.

This unpaid overtime adds up significantly over weeks, months, and years. The FLSA establishes the rules for what minimum overtime compensation must be paid, and Dungarvin’s hourly in-home care employees are entitled to receiving their full compensation.

Our lawsuit seeks these unpaid overtime wages for Dungarvin’s hourly employees since September 7, 2019, additional liquidated damages in an amount equal to the unpaid overtime (200% of the unpaid overtime damages total), and attorneys’ fees and costs. The lawsuit was filed in the U.S. District Court for the Southern District of Ohio, Eastern Division (Columbus), and is entitled Duvall v. Dungarvin, Ohio, LLC¸ Case No. 2:22-cv-3372.
