Piece Rate Overtime Lawsuit Filed Against Forest River RV

Overtime lawyers at our firm (along with attorneys at Nilges Draher LLC and Hassler Kondras Miller LLP) filed a wage and hour case against Forest River challenging its piece-rate pay system. In the lawsuit, we allege that Forest River production workers were not paid on a “bona fide” piece rate system and were thus owed additional overtime wages.

On December 2, 2020, a Collective and Class Action Complaint was filed against Forest River Manufacturing, LLC (“Forest River”) on behalf of non-exempt “piece rate” production workers to recover overtime earned but not paid by Forest River in violation of the Fair Labor Standard Act (“FLSA”). The Complaint alleges that Forest River RV has failed to fully and properly compensate its “piece rate” workers the overtime wages they earned because Forest River’s “piece rate” pay system improperly included nonproductive work hours in its calculation of “piece rate” employees’ overtime rates. Moreover, the lawsuit alleges that Forest River also took unlawful wage deductions from its employees’ pay.

This lawsuit provides an example of how “piece rate” employees may not be paid all overtime wages they earned.  The lawsuit was filed in the U.S. District Court for the Northern District of Indiana, South Bend Division and is titled Fitzgerald v. Forest River Manufacturing, LLC, Case No. 3:20-cv-1004.
