On August 23, 2017, the law firms of Coffman Legal, LLC and Bryant Legal, LLC filed a Collective and Class Action Complaint against Defendants Discover Financial Services and Discover Products (collectively “Discover”) on behalf of a Discover call center employee and Discover’s other similarly situated employees regardless of location for Discover’s failure to fully and properly compensate its employees for all overtime wages in violation of the Fair Labor Standard Act (“FLSA”). Discover is a for-profit bank and financial holding corporation with numerous call center locations throughout the United States of America. The collective and class action was filed to redress Discover’s alleged failure to fully pay overtime wages they are entitled to under the FLSA for all Discovery employees.
The lawsuit brought by the former non-exempt Discover call center employee was brought on behalf of all Discover hourly employees who worked over 40 hours in a workweek and received a shift premium. The former Discover call center employee alleged that she and other similarly situated employees received additional compensation when they worked on specific days and/or at specific times, such as on Sunday. Although they received the shift premium for working specific shifts, the former Discover employee alleges that the shift premium was not properly included in Discover’s calculation of their regular rate of pay, resulting in unpaid overtime wages for herself and all other employees who also received the shift premium in workweeks that they worked in excess of 40 hours.
The lawsuit was filed in the U.S. District Court for the Southern District of Ohio, Eastern Division (Columbus) and is titled Griffith v. Discover Products, Inc., et al, Case No. 2:17-cv-00743.
