On March 15, 2017, a former non-exempt home health care employee filed a complaint in the Southern District of Ohio against Upreach, LLC including collective and class action allegations for failure to pay overtime wages to support specialists and other employees since January 1, 2015. The named plaintiff filed a claim for failure to pay overtime wages for each hour worked in excess of 40 in a workweek on behalf of herself and all other similarly situated non-exempt employees, including home health aides, support specialists, etc.

The Complaint alleges violations of the FLSA and Ohio’s laws which require non-exempt employees to receive time-and-a-half for each hour worked over 40 in a workweek. For home health employees, the home care rule was changed in 2015 entitling them to overtime wages for hours worked in excess of 40 each workweek. The complaint seeks unpaid overtime wages, liquidated (double damages), attorneys’ fees, and costs. Upreach has denied any wrongdoing.
