On June 15, 2017, a former non-exempt employee filed a first amended complaint in the Northern District of Ohio against Toledo Tool & Die Company, Inc. including collective and class action allegations. The named plaintiff filed a claim for failure to pay overtime wages for each hour worked in excess of 40 in a workweek on behalf of himself and all other similarly situated non-exempt employees.

The First Amended Complaint alleges violations of the FLSA and Ohio’s laws which require non-exempt employees to receive time-and-a-half for each hour worked over 40 in a workweek. The complaint seeks unpaid overtime wages, liquidated (double damages), attorneys’ fees, and costs. Included with the First Amended Complaint were payroll records produced by TTD which indicate that unidentified, other non-exempt employees also were not properly paid 1.5 times their regular rate of pay for each hour worked over 40 in a workweek.
