NEW UNPAID OVERTIME LAWSUIT FILED BY CALL CENTER EMPLOYEES AGAINST BMW FINANCIAL SERVICES

Coffman Legal’s FLSA Overtime Attorneys filed a Collective and Class Action Lawsuit against BMW Financial Services NA, LLC on behalf of call center employees who were allegedly not compensated for all overtime work performed.

On May 5, 2020, the law firm of Coffman Legal, LLC filed a Collective and Class Action Complaint against BMW Financial Services NA, LLC (“BMW Financial Services”) on behalf of BMW Financial Services’s call center employees for BMW Financial Services’s alleged failure to fully compensate call center employees for all time that they spent working. In particular, the lawsuit alleges that call center employees were not compensated for computer bootup processes that were integral and indispensable to their job duties. Instead, BMW Financial Services’s call center employees were only able to clock in after they completed certain bootup processes. The case is filed as a collective action (under the Fair Labor Standards Act) and class action (under Ohio law).

The Complaint alleges that BMW Financial Services’s failure to pay call center employees for all time working resulted in unpaid overtime in violation of the FLSA.

The lawsuit seeks unpaid overtime wages since May 5, 2017, liquidated damages in an amount equal to the unpaid overtime, attorney’s fees, and costs, among other things. The lawsuit was filed in the U.S. District Court for the Southern District of Ohio, Eastern Division (Columbus) and is titled Rawlings v. BMW Financial Services NA, LLC, Case No. 2:20-cv-2289.
