In general, an employer must compensate an employee for all hours worked, including time spent training. In other words, training time is ordinarily work time. If training occurs while the employee is at work by way of meeting, lecture, or otherwise, the training time is work time.

However, training time does not have to be counted as work time if all of the following are met:

  1. the training occurs outside of regular business hours;
  2. an employee voluntarily attends the training course;
  3. the training course is not job-related; and
  4. the employee does not perform productive work during the training.

Attendance is not voluntary if, an employee’s employer requires attendance. In addition, training is directly related to an employee’s job if it is “designed to make the employee handle his job more effectively as distinguished from training him for another job, or to a new or additional skill.”
