The Fair Labor Standards Act requires employers to compensate hourly, non-exempt employees at least minimum wage, as well as overtime wages for all hours worked in excess of 40 in a given workweek. Many employers’ timekeeping systems include “rounding” depending on when the employees clock in. Rounding employees’ compensable hours worked is lawful subject to certain requirements.

Employers may track employees’ compensable hours worked to the nearest tenth or quarter of an hour, so long as the employer does not always round down. For example, if an employer rounded to the nearest quarter of the hour, the employer would round down for minutes 1-7 (and not counted as hours worked) if the employees’ time for 8-14 minutes would be rounded up (and counted as a quarter hour worked).
